Terms and Conditions / Policies

RETURN & EXCHANGE POLICY

We want you to be pleased with your purchase from BillyTheTree Jewelry. Most eligible items may be returned within 30 days, subject to the conditions and exclusions in our current Returns & Exchanges policy.

Certain items, including personalized and engraved products, are final sale and are not eligible for return or exchange except where required by applicable law. Shipping charges and shipping protection / insurance are non-refundable except where otherwise stated in our Returns & Exchanges policy or required by law.

Manufacturer warranties: Some products may include a warranty provided by the product manufacturer or another identified warrantor. Any manufacturer warranty is separate from BillyTheTree's 30-day return policy and is governed by the manufacturer's warranty terms. Where a manufacturer warranty is advertised for a product, please review the warranty information provided with or referenced on the product page, or contact us before purchase if you need a copy of the applicable warranty terms.

OTHER IMPORTANT POLICIES

Currency:

All funds are in US Dollar. Foreign currency pricing is provided for informational purposes, and the complete accuracy of these foreign currency prices cannot be guaranteed (they are updated daily by a third party).

Store Credit Promotions:

From time to time, we may offer a promotion in which we offer a store credit, contingent upon a minimum order amount, e.g., "Spend $100, get a $10 store credit". This store credit will be emailed to you after your order has shipped. If you return items in your order for either a full refund (excluding shipping or other non-refundable charges), or a partial refund that leaves a remaining non-refunded amount that is less than the threshold that was required to earn the store credit, then we will deactivate the store credit you received. If the store credit was already used in a subsequent order, then we will deduct the amount of the store credit from your refund amount.

Privacy Policy

BillyTheTree, LLC (“BillyTheTree,” “we,” “us,” or “our”) operates BillyTheTree.com. This Privacy Policy explains how we collect, use, disclose, and protect information when you visit our website, place an order, create an account, contact us, subscribe to our emails, interact with our advertising, or otherwise use our website and services.

We are a United States-based ecommerce business. By using our website, you acknowledge the practices described in this Privacy Policy.

Important Notice Regarding Restricted Locations

BillyTheTree.com is not intended for use by individuals located in the European Union, European Economic Area, United Kingdom, or Switzerland. We do not offer goods or services to those locations, do not ship to those locations, do not target advertising to those locations, and do not intend for our website, products, checkout, customer accounts, email marketing, or services to be used by individuals located in those locations.

If you are located in the European Union, European Economic Area, United Kingdom, or Switzerland, do not use this website, create an account, submit information, subscribe to emails, place an order, contact us through website forms, or otherwise provide personal information to us. Please leave this website immediately.

If we determine that an order, account, inquiry, email signup, or other submission is from a restricted location, we may cancel the order, decline service, delete the account or submission where appropriate, unsubscribe the email address where appropriate, and take other steps to prevent use of our website or services from that location.

1. Information We Collect

We use a limited IP-based state lookup to apply location-appropriate privacy defaults. The lookup is performed without sending the page visited, referring URL, advertising click identifiers, form contents, or purchase information. The resulting regional preference is stored briefly and reassessed periodically. Privacy choices can be changed at any time through the Privacy Choices link.

We collect information in several ways: information you provide directly, information collected automatically when you use our website, and information received from service providers, ecommerce platforms, advertising partners, payment providers, shipping providers, fraud-prevention tools, email marketing tools, customer review tools, and related business services.

Information You Provide Directly

Information you provide directly may include:

  • Name
  • Email address
  • Billing address
  • Shipping address
  • Phone number
  • Account login information
  • Order details
  • Payment-related information
  • Customer service messages
  • Contact form submissions
  • Product personalization, engraving, sizing, or special-order information
  • Newsletter signup information
  • Reviews, survey responses, or other content you choose to submit

We do not store full credit card numbers on our own servers. Payment information is processed by our ecommerce platform and payment processors.

Information Collected Automatically

When you use our website, we and our service providers may automatically collect information such as:

  • IP address
  • Browser type and version
  • Device type
  • Operating system
  • Pages viewed
  • Products viewed
  • Referring pages
  • Date and time of visits
  • Approximate location based on IP address
  • Shopping cart activity
  • Search activity on our website; internal search terms are processed by BillyTheTree and BigCommerce to return results, but are removed from the browser URL before optional analytics or advertising technologies are enabled
  • Clicks and interactions with site features
  • Cookie identifiers and similar online identifiers
  • Advertising click identifiers, such as gclid, gbraid, wbraid, msclkid, fbclid, OpenAI click references such as oppref, or similar identifiers, when applicable

2. How We Use Information

We use information for the following purposes:

  • To operate and maintain our website
  • To process, fulfill, and ship orders
  • To provide customer service
  • To manage customer accounts
  • To communicate about orders, returns, exchanges, questions, and support requests
  • To send marketing emails if you subscribe or otherwise opt in
  • To prevent fraud, abuse, bots, spam, unauthorized activity, and security incidents
  • To improve website performance, layout, product selection, and customer experience
  • To understand how customers use our website
  • To measure advertising performance
  • To show or measure relevant advertising, where permitted by your cookie choices and applicable law
  • To administer customer reviews, surveys, or post-purchase feedback requests
  • To comply with legal, tax, accounting, chargeback, and regulatory obligations
  • To enforce our terms, policies, and rights
  • To protect the rights, safety, and property of BillyTheTree, our customers, and others

3. Cookies and Similar Technologies

We use cookies, pixels, tags, scripts, web beacons, local storage, and similar technologies. Some are required for the site to work. Others are optional and depend on your cookie choices.

You can accept, reject, or customize non-essential cookies through our cookie banner and Cookie Settings link where available. Your browser may also allow you to block or delete cookies. Blocking some cookies may affect website functionality.

Essential / Strictly Necessary Technologies

Essential cookies and technologies are required for the website to work. They support core functions such as page navigation, shopping cart, checkout, account login, fraud prevention, bot protection, security, form protection, order processing, and remembering your privacy choices. These cannot be turned off through our cookie settings.

Functional Technologies

Functional cookies and technologies improve optional site features, such as accessibility tools, customer review features, currency or display preferences, warranty or product-option features, and other enhanced shopping features. If you turn these off, some optional features may not work as intended.

Analytics Technologies

Analytics technologies help us understand how visitors use our website, which pages are visited, how the site performs, and how orders are attributed in our reports. We use this information to improve our store and customer experience. Analytics tags and their remote libraries do not load unless the Analytics category is enabled under the regional default or by your affirmative choice. When Analytics is disabled, our optional Analytics loader remains blocked.

Targeting / Advertising Technologies

Targeting and advertising technologies help us measure ads, understand ad performance, build advertising audiences, and show more relevant offers on platforms such as Google, Microsoft/Bing, Meta/Facebook, OpenAI/ChatGPT ads, PayPal, and related advertising partners. Advertising tags and their remote libraries do not load unless the Targeting/Advertising category is enabled under the regional default or by your affirmative choice. When Targeting/Advertising is disabled, our optional Google, Microsoft/Bing, Meta, and OpenAI advertising loaders remain blocked. When this category is enabled, advertising partners may receive information such as pages viewed, product interactions, device/browser identifiers, approximate location from your IP address, ad click identifiers, OpenAI click references such as oppref where applicable, and purchase events. Internal site-search terms are removed from the browser URL before optional advertising technologies are enabled. For purchase measurement, we may send limited transaction information and, where supported or enabled, hashed customer matching information, such as email address and limited matching fields such as name or location, for ad attribution and measurement.

4. Cookie Banner and Privacy Choices

Our cookie banner gives you choices about non-essential cookies and similar technologies. Essential cookies and security technologies are always active because they are needed for the site to work, protect against fraud and abuse, maintain the cart and checkout, protect forms, and remember your privacy choices.

You may be able to accept all cookies, reject non-essential cookies, or customize your choices by category. You can change your choices at any time through our Cookie Settings link where available.

Regional Privacy Defaults

We use a limited IP-based country and state lookup to select the appropriate first-visit privacy default. While the lookup is being completed, optional Functional, Analytics, and Targeting/Advertising technologies remain blocked. The lookup request is configured not to send the page you visited as a referrer, and we do not store your complete IP address in the regional-preference cookie.

For visits detected in California, outside the United States, or from an unknown location, optional Analytics and Targeting/Advertising technologies remain disabled unless the visitor affirmatively enables them. For other United States visits, optional technologies may be enabled by default and may be disabled at any time through Cookie Settings. When we receive a recognized Global Privacy Control signal, Targeting/Advertising technologies are disabled by default. A saved affirmative or restrictive choice takes precedence over the regional default, except that an active Global Privacy Control signal is honored as an advertising opt-out.

Before optional Analytics or Targeting/Advertising technologies are enabled, BillyTheTree removes BigCommerce's internal search_query value from the browser URL without refreshing or navigating away from the rendered search-results page. This prevents optional advertising and analytics providers from receiving the shopper's internal search words through the page URL or an automatic search event.

Rejecting non-essential cookies does not prevent you from shopping on our website, but it may limit optional features, analytics, advertising personalization, customer review features, PayPal promotional messaging, accessibility tools, currency/display features, or other enhanced site functionality.

5. Analytics

We use Google Analytics to understand website usage, performance, and purchase attribution when the Analytics category is enabled. Our Google Analytics loader is assigned to BigCommerce's Analytics consent category, so its remote library does not load while Analytics is disabled. When enabled, Google Analytics may use analytics cookies and collect information such as sanitized page URLs, pages viewed, browser/device information, approximate location, interaction data, and ecommerce events. We remove raw BigCommerce internal search terms from the browser URL before optional analytics is enabled.

You can learn more about Google’s privacy practices at: https://policies.google.com/privacy

6. Advertising and Remarketing

When the Targeting/Advertising category is enabled under the applicable regional default or by your affirmative choice, we may use advertising technologies from Google Ads, Microsoft/Bing Ads, Meta/Facebook, OpenAI Ads Manager/ChatGPT ads, PayPal, and other advertising or measurement partners. These optional advertising loaders and their remote libraries do not load while Targeting/Advertising is disabled, including on order-confirmation pages.

These technologies may help us:

  • Measure ad performance
  • Attribute purchases to ads
  • Understand which ads led to visits or orders
  • Build or refine advertising audiences
  • Show more relevant ads on other websites or platforms
  • Limit irrelevant advertising

When Targeting/Advertising is enabled, advertising and measurement partners may receive information such as pages viewed, product interactions, cart or checkout events, purchase events, order value and currency, transaction ID, browser and device identifiers, IP address, approximate location, ad click identifiers, OpenAI click references such as oppref where applicable, and a hashed email address for purchase attribution where supported. Internal site-search terms are removed from the browser URL before optional advertising loads. Hashed customer matching information for advertising attribution is only sent where supported or enabled and where the applicable consent category allows it.

We do not intentionally send full payment card information to advertising partners.

7. Email Marketing

If you subscribe to our emails, we may use your email address and related information to send newsletters, promotions, product updates, sale announcements, and other marketing messages. You can unsubscribe by using the unsubscribe link in our emails or by contacting us.

We use Blastable and may use related email marketing service providers to manage subscriptions, send email campaigns, maintain suppression lists, and measure email engagement. These providers may process email addresses, names where provided, subscription status, email delivery information, opens, clicks, unsubscribe activity, and related engagement information on our behalf.

Submitting your email address for marketing does not require you to accept Targeting/Advertising cookies. However, email marketing tools may process the information you provide when you sign up or interact with our emails.

8. Payments

We use third-party payment processors and ecommerce platform services to process payments. We do not store full credit card numbers on our own servers. Payment processors may collect payment card details, billing information, fraud-prevention information, and transaction details to process your payment and comply with their legal and security obligations.

Payment providers we use may include:

  • BigCommerce payment services
  • PayPal
  • Authorize.net
  • Klarna or other buy-now-pay-later providers, where available
  • Other payment methods or processors made available at checkout

Your use of a payment method may also be subject to that provider’s privacy policy and terms.

9. Fraud Prevention, Security, and Bot Protection

We use security, fraud-prevention, bot-detection, geolocation, and abuse-prevention technologies to protect our website, customers, forms, checkout, advertising, and business operations.

These technologies may collect information such as:

  • IP address
  • Browser and device information
  • Page URL and referrer
  • Interaction signals
  • Network and diagnostic information
  • Fraud or risk indicators
  • Order and transaction context where applicable

Security-related tools may include services such as Google reCAPTCHA, FraudBlocker, BigCommerce security tools, geolocation/blocking tools, and similar technologies. These tools are used to prevent spam, fraud, malicious traffic, unauthorized activity, bot traffic, suspicious ad clicks, and abuse.

We may block, limit, challenge, or investigate traffic that appears fraudulent, malicious, automated, unsupported, or otherwise abusive.

10. Customer Reviews

We may use Google Customer Reviews or similar review tools to collect voluntary customer feedback. If you choose to participate in a review request, Google or another review provider may receive transaction-related information needed to provide the survey or display review features, such as order ID, email address, delivery country, and estimated delivery date.

Participation in customer review surveys is voluntary.

11. Accessibility, Currency, Warranty, and Other Functional Site Tools

We may use accessibility, display, currency, warranty, product-option, product-protection, or other functional tools to improve the shopping experience. These tools may process device/browser information, page context, product identifiers, interaction data, or feature-specific information needed to provide the requested functionality.

Depending on your cookie choices and the feature involved, these tools may include services such as accessibility widgets, currency/location display tools, product protection or warranty tools, customer review widgets, and similar optional functionality.

14. Sale or Sharing of Personal Information

Some privacy laws define “sale” or “sharing” broadly. We do not sell customer lists for money. However, if Targeting/Advertising is enabled under the applicable regional default or by your choice, our use of advertising pixels, tags, cookies, and similar technologies may be considered a “sale,” “sharing,” or disclosure of personal information for cross-context behavioral advertising under certain privacy laws. These optional advertising technologies remain blocked when Targeting/Advertising is disabled.

You can opt out of these technologies by rejecting Targeting/Advertising cookies in our cookie settings. You may also use browser or platform controls where available.

Where required by applicable law, we will honor valid opt-out preference signals, such as Global Privacy Control, to the extent our systems are able to recognize and process them.

15. Cookie Settings / Do Not Sell or Share

We do not sell customer lists for money. However, some privacy laws define “sale” or “sharing” broadly. If Targeting/Advertising is enabled under the applicable regional default or by your choice, advertising partners such as Google, Microsoft/Bing, Meta/Facebook, OpenAI Ads Manager/ChatGPT ads, PayPal, and related partners may receive online identifiers and website activity, such as sanitized pages viewed, product interactions, ad click identifiers, and purchase events, to measure ads and provide more relevant advertising. Raw internal site-search terms are removed from the browser URL before these optional technologies are enabled. When Targeting/Advertising is disabled, these optional advertising loaders and their remote libraries remain blocked.

To opt out of this type of sharing, disable Targeting/Advertising cookies in our cookie settings.

If available, you may use the Cookie Settings link on our website to review or change your cookie choices at any time.

16. Your Choices

California residents may have rights under California privacy laws, including the right to know, delete, correct, and opt out of sale or sharing of personal information, where those laws apply.

We do not sell customer lists for money. However, as described above, enabling Targeting/Advertising may permit advertising partners to receive online identifiers, sanitized page activity, product interactions, ad click identifiers, and purchase-related events, which may be considered “sharing” or “sale” under California law. Raw internal site-search terms are removed from the browser URL before optional advertising technologies are enabled.

To opt out of Targeting/Advertising cookies, use our Cookie Settings link and disable Targeting/Advertising cookies.

California residents may also contact us at: customerservice@billythetree.com

Manufacturer Warranties:

Manufacturer warranties advertised on BillyTheTree.com are provided by the applicable product manufacturer and are separate from BillyTheTree's return policy. Full written warranty terms are available free of charge before purchase upon request. To request warranty terms for a specific product, contact us and provide the product name and SKU. We will obtain or provide the applicable manufacturer's warranty information before purchase. You may contact us in writing to

BillyTheTree, LLC 3665 E Bay Dr Suite 204, #157 Largo, FL 33771

or by writing to us at customerservice@billythetree.com .

Shipping and Handling:

Orders are usually shipped within 2-5 business days unless a different timeframe is stated for a particular product or order. Orders may be shipped by UPS, FedEx, USPS, or another carrier as appropriate. Shipping and handling charges are shown during checkout before you submit your order. We reserve the right to decline or cancel an order or shipment; if we cancel an order after payment has been collected, the applicable amount will be refunded.

Delivery dates and transit times are estimates and may be affected by carrier delays, weather, customs, address problems, natural disasters, or other circumstances outside our reasonable control. If we learn that we cannot ship within the timeframe promised at the time of sale, we will provide any delay notice, cancellation option, revised shipment information, and refund required by applicable law.

If an order is lost, damaged, delayed, or appears to have been misdelivered, please contact us. We may ask for photographs, tracking information, carrier documentation, or other reasonable information needed to investigate the issue, and we may coordinate with the carrier or shipping-protection provider as appropriate. Carrier tracking and delivery information may be considered when resolving a delivery claim. Optional shipping protection or insurance, where offered, is subject to the terms and limitations applicable to that coverage.

If an order is returned to us by a carrier because the shipping address provided with the order was incomplete or incorrect, any reshipment may require payment of additional shipping charges. This also applies to second and subsequent shipment attempts.

Backorders:

If part of an order is temporarily unavailable, we may ship available items separately and ship the remaining items later. If a backorder or other delay prevents us from shipping within the timeframe promised at the time of sale, we will notify you and provide the revised shipment information and the opportunity to cancel and receive a refund as required by applicable law. We may also cancel and refund an unavailable item or order rather than continue to delay shipment.

Payment:

We accept Visa, Mastercard, Discover, American Express, PayPal, and any other payment methods displayed as available during checkout. Payment authorization and processing are handled through the applicable payment provider and our ecommerce platform when you submit your order.

We do NOT accept checks or money orders for payment.

Importation Policy:

Please know your country's import policy. The buyer is responsible for any import restrictions, prohibited import items, taxes, tariffs, fees, duties, etc. We are NOT responsible for customs fees, duties, and other taxes that may be assessed for international shipments by foreign governments or their agencies. These charges are outside our control, and you must be aware of your country's import policies and laws. If such charges are levied, then you are responsible for paying them.

If you reject your shipment, and customs and or postal notes indicate that you did not pay import, customs, or any other legally required fees or payments, and your shipment is returned to us, then, unless arrangements for re-delivery are made (we will make attempts to contact you), we will deduct a $16.95 flat fee from your refund amount to cover our cost of shipping. It is your responsibility to be aware of laws and responsibilities that pertain to your function as an importer.
